Parties and Contract Type
This Employment Contract is between the Employer, a creative, digital, marketing, or professional services agency delivering project-based work for a portfolio of clients, and the Employee. The agency handles client briefs across strategy, design, development, content, media, or a combination, staffing cross-functional teams to deliver campaigns, websites, brands, and digital products.
Employment is permanent from the Start Date under applicable employment law. This contract is the complete agreement between the parties and supersedes all prior communications.
Agency work involves managing multiple client accounts simultaneously, meeting tight creative deadlines, adapting to shifting client priorities, and maintaining quality across concurrent projects. The Employee accepts this pace and client-service orientation as central to the role.
Term, Probation, and Probation Review
A three-month probation period applies. The Employer assesses the Employee's craft quality in their discipline, ability to manage multiple client deadlines, responsiveness to creative feedback, and contribution to the agency's collaborative culture and client satisfaction scores.
Statutory notice applies during probation. A review at six weeks covers the Employee's output quality on completed briefs, time tracking accuracy against project budgets, client communication competence, and alignment with the agency's creative standards and brand voice guidelines.
Permanent employment follows successful probation. Extension is available if the Employee has not yet worked across a sufficient variety of client types or requires further development in client-facing presentation and pitch skills.
Duties, Role, and Exclusivity
The Employee delivers work within their discipline across assigned client accounts, collaborates with cross-functional teams, and contributes to pitches and proposals. Freelance work for competing agencies or conflicting clients requires the Employer's written consent.
Remuneration, Benefits, and Pay
Salary is paid monthly in arrears. Benefits may include a creative development budget, conference attendance, and flexible working arrangements. Overtime during pitch periods or campaign launches may be compensated with time off in lieu.
Working Time, Location, and Hours
The Employee works from the agency office, remotely, or on a hybrid basis as agreed. Client meetings may require travel. Campaign launch deadlines and pitch preparations may temporarily extend working hours beyond the standard week.

Why agency businesses need a employment contract
Agency employees often handle sensitive information, operate specialised equipment, or interact directly with customers, making role-specific employment contracts essential. A agency employment contract must address industry-standard working patterns, health and safety obligations, and any required certifications or training. Restrictive covenants like non-compete and non-solicitation clauses need to be calibrated to agency market norms to be enforceable.
The global digital agency market is projected to reach $850 billion by 2028.
