Parties and Contract Type

This Employment Contract is between the Employer, a registered childcare center providing day nursery, pre-school education, and after-school care for children from infancy through school age, and the Employee. The center operates under regulatory oversight from the relevant childcare inspectorate and employs qualified nursery practitioners, room leaders, and support staff who meet the minimum qualification requirements for their role.

Employment is permanent from the Start Date, governed by the employment laws and childcare regulations of the applicable jurisdiction. This contract is the complete agreement and incorporates the center's safeguarding policy by reference.

Working with children demands enhanced background checks, adherence to child-to-staff ratios, mandatory reporting obligations for safeguarding concerns, and compliance with the Early Years Foundation Stage or equivalent curriculum framework. The Employee commits to these requirements as conditions of employment.

Term, Probation, and Probation Review

Probation lasts three months. The Employer evaluates the Employee's interaction quality with children in their age group, adherence to safeguarding protocols, delivery of age-appropriate learning activities aligned to the curriculum framework, and ability to maintain the required documentation including learning journals, incident reports, and daily registers.

Statutory notice applies during probation. A review at six weeks covers the Employee's relationship-building with children and parents, compliance with nappy changing and medication administration procedures, contribution to the room's learning environment, and professionalism in maintaining appropriate boundaries.

Permanent employment follows successful probation. Extension may be offered if the Employee is completing a Level 3 childcare qualification or requires additional supervised practice in a different age group room.

Duties, Role, and Exclusivity

The Employee plans and delivers learning activities, maintains child welfare records, communicates with parents, and follows safeguarding and health and safety procedures. Outside childcare employment is permitted but must not conflict with the center's operating hours or safeguarding standards.

Remuneration, Benefits, and Pay

Salary is paid monthly in arrears. The Employer may offer a childcare place at a reduced rate for the Employee's own children. Funding for additional childcare qualifications is available at the Employer's discretion, subject to a training agreement.

Working Time, Location, and Hours

The center operates on weekdays from early morning to early evening. The Employee works a shift pattern within these hours. The workplace is the nursery premises. Staff meetings and training may occasionally extend beyond normal hours.

Why childcare center businesses need a employment contract

Childcare Center employees often handle sensitive information, operate specialised equipment, or interact directly with customers, making role-specific employment contracts essential. A childcare center employment contract must address industry-standard working patterns, health and safety obligations, and any required certifications or training. Restrictive covenants like non-compete and non-solicitation clauses need to be calibrated to childcare center market norms to be enforceable.
