Parties and Contract Type
This Employment Contract is between the Employer, a farm producing crops, livestock, dairy, or mixed agricultural products, and the Employee. The farm operation encompasses fieldwork, animal husbandry, machinery operation, and potentially direct sales through farm shops or farmers markets, requiring versatile workers who can adapt to seasonal demands and variable weather conditions.
Employment is permanent from the Start Date under the employment laws of the applicable jurisdiction. This contract constitutes the full agreement. Agricultural employment has sector-specific regulations around working time, housing, and minimum pay that this contract complies with.
Farm work is physically demanding and involves operating tractors, combines, and PTO-driven machinery, handling livestock, working in all weather conditions, and exposure to dust, chemicals, and biological hazards. The Employee accepts these conditions and maintains any required machinery operation certifications and pesticide handling qualifications.
Term, Probation, and Probation Review
Probation runs for three months. The Employer evaluates the Employee's competence in their primary duties (livestock handling, tractor operation, crop husbandry, milking, or general farm maintenance), safety awareness around machinery and animals, physical stamina for sustained outdoor work, and willingness to take on varied tasks as the farm's seasonal calendar demands.
Statutory notice applies during probation. A review at six weeks covers the Employee's ability to work independently on routine tasks, livestock welfare observations, machinery maintenance discipline, and integration with the existing farm team.
Permanent employment follows successful probation. Extension may apply if the Employee has not yet experienced a full seasonal cycle (planting through harvest, or calving through weaning) or requires additional machinery certification.
Duties, Role, and Exclusivity
The Employee performs agricultural duties including crop management, livestock care, machinery operation, and property maintenance. Farm work is varied by nature, and the Employee may be assigned tasks across multiple disciplines. Competing agricultural employment requires written consent.
Remuneration, Benefits, and Pay
Salary is paid monthly in arrears at or above the agricultural minimum wage. Tied accommodation may be provided under an agricultural occupancy condition. Overtime applies for harvest and calving period hours beyond the standard working week.
Working Time, Location, and Hours
Working hours follow the farm's seasonal pattern. Early morning starts are standard for livestock operations. The Employee works from the farm premises and surrounding fields. Harvest and lambing periods may require extended hours including weekends and early mornings.

Why farm businesses need a employment contract
Farm employees often handle sensitive information, operate specialised equipment, or interact directly with customers, making role-specific employment contracts essential. A farm employment contract must address industry-standard working patterns, health and safety obligations, and any required certifications or training. Restrictive covenants like non-compete and non-solicitation clauses need to be calibrated to farm market norms to be enforceable.
