Parties and Contract Type
This Employment Contract is between the Employer, a franchised or independent auto dealership selling new and pre-owned vehicles, parts, and after-sales services, and the Employee. The dealership operates a showroom, forecourt, service workshop, and parts department, employing sales consultants, finance managers, service advisors, technicians, and administrative staff.
The Employee joins permanently from the Start Date under applicable employment law. This contract constitutes the entire agreement. The automotive retail sector is regulated by manufacturer franchise agreements, FCA rules on motor finance, and consumer protection legislation, and the Employee commits to compliance with all applicable requirements.
Dealership roles involve representing the brand to the public, handling high-value transactions, managing customer finance applications, and working in a target-driven commercial environment. The Employee accepts these professional expectations.
Term, Probation, and Probation Review
Probation lasts three months. For sales staff, the Employer evaluates product knowledge across the model range, customer engagement quality, finance penetration rates, and compliance with consumer credit regulations. For workshop staff, assessment covers technical competence, manufacturer training progression, and efficiency against standard repair times.
Statutory notice applies during probation. A review at six weeks addresses the Employee's progress against sales targets or workshop productivity benchmarks, manufacturer training module completion, CRM usage discipline, and customer satisfaction survey results.
Permanent employment follows successful probation. Extension is available if the Employee is still completing mandatory manufacturer accreditation or FCA compliance training that runs beyond the initial three-month window.
Duties, Role, and Exclusivity
The Employee performs sales, service advisory, workshop, or administrative duties as assigned within the dealership. Employment at a competing dealership or private vehicle trading requires the Employer's prior written consent.
Remuneration, Benefits, and Pay
Monthly base salary is paid in arrears. Commission and bonus structures for sales and aftersales roles are detailed in Schedule 2. Staff may access demonstrator vehicles and receive discounts on new car purchases and parts.
Working Time, Location, and Hours
The dealership operates six or seven days a week. The Employee works a rota covering showroom opening hours, including evenings for late-night shopping events. The workplace is the dealership premises, with occasional off-site attendance at motor shows or launch events.

Why auto dealership businesses need a employment contract
Auto Dealership employees often handle sensitive information, operate specialised equipment, or interact directly with customers, making role-specific employment contracts essential. A auto dealership employment contract must address industry-standard working patterns, health and safety obligations, and any required certifications or training. Restrictive covenants like non-compete and non-solicitation clauses need to be calibrated to auto dealership market norms to be enforceable.
