Parties and Contract Type
This Employment Contract is between the Employer, a landscaping company providing design, installation, and maintenance of outdoor spaces for residential, commercial, and municipal clients, and the Employee. The company handles hardscaping (patios, retaining walls, drainage), softscaping (planting, turfing, irrigation), and ongoing grounds maintenance contracts.
Employment is permanent from the Start Date under applicable employment legislation. This contract constitutes the entire agreement between the parties.
Landscaping work is physically demanding, involving operation of excavators, skid steers, and compaction equipment, manual labor in varying weather, and handling heavy materials such as stone, concrete, and mature trees. The Employee accepts these conditions as fundamental to the role.
Term, Probation, and Probation Review
A three-month probationary period applies. The Employer evaluates the Employee's construction skills (paving, wall building, grading), plant knowledge and installation technique, ability to read and execute landscape design plans, and safe operation of equipment including mini excavators and plate compactors.
Statutory notice applies during probation. A review after six weeks addresses the Employee's output quality on current projects, their ability to work independently on routine tasks, compliance with site safety requirements, and teamwork with designers and project managers.
Permanent employment follows successful probation. Extension may occur if the Employee requires additional training on irrigation system installation, machine operation tickets, or CAD-based landscape design software.
Duties, Role, and Exclusivity
The Employee performs hardscape construction, planting, grading, irrigation installation, and grounds maintenance as assigned. Competing landscaping or grounds maintenance work requires the Employer's written consent.
Remuneration, Benefits, and Pay
Monthly salary is paid in arrears, with an uplift for employees holding machine operation certifications. The Employer provides all tools, PPE, and work boots. Overtime applies for weekend project deadlines.
Working Time, Location, and Hours
The Employee works at client project sites, starting from the company yard each morning. Hours follow daylight and weather conditions. Winter may involve snow clearance, indoor nursery work, or reduced hours depending on project pipeline.
