We request utility locator services before digging, but rely on marking accuracy and your disclosure of private underground systems (irrigation, septic, low-voltage wiring). We carry comprehensive liability and worker's comp coverage.
Scope of Services
Design services include site analysis, concept development, planting plans, hardscape layouts, material selection, and construction documentation. Design fees are separate from installation and due on delivery. You receive a license to implement the design on your property. Design IP stays with us unless otherwise agreed.
Installation covers earthwork, grading, soil amendment, planting, sod or seed establishment, mulching, and irrigation setup. Hardscape work includes patios, walkways, retaining walls, fire pits, outdoor kitchens, pergolas, and fencing in natural stone, pavers, composite, or timber.
We select plant material from nurseries based on suitability, mature size, site conditions, and your preferences. While we choose healthy specimens and use proper planting techniques, we cannot guarantee survival of every plant given weather, soil, pests, and your ongoing care.
Maintenance programs range from basic mowing and edging to comprehensive horticultural management with plant health monitoring, seasonal bed rotation, and irrigation oversight.
Acceptable Use
Disclose all underground utilities, irrigation, and buried structures before excavation. We are not liable for damage to undisclosed infrastructure. Maintain newly installed plants according to our watering and care instructions during the establishment period.
Intellectual Property
All landscape designs, planting plans, and construction details remain our IP. You receive a single-property implementation license. The design may not be replicated on other properties without our written consent.
Limitation of Liability and Indemnities
Our aggregate liability is capped at the project contract value. We are not liable for plant death from failure to follow care instructions, undisclosed underground damage, or project delays from weather, permits, or material supply disruptions beyond our control.
